NUVI GDPR Compliance Statement

    The General Data Protection Regulation (GDPR) is effective May 25, 2018, and governs personal information that is processed in or exported from the EU (European Union) or EEA (European Economic Area), or belongs to EU/EEA citizens. Most information used by NUVI is public information, but it may include “personal information” as broadly defined under GDPR. Therefore, NUVI complies with GDPR where required. NUVI primarily analyzes public information that individuals (“Users”) post on social media platforms such as Twitter, Instagram and the like. Users posting on these platforms “opt in” through creating accounts and accepting terms of use, and can adjust privacy setting through the platforms on which they post. NUVI purchases public data in bulk from social media platforms and third party sources (Content Providers) after Users have opted in and given consent for their public posts and related data to be analyzed by services such as NUVI. NUVI does not have a direct relationship with Users who post the content, but NUVI will honor requests, when forwarded by Content Providers on behalf of their Users, to modify, delete or port personal information in compliance with GDPR, if such information is contained in the data NUVI analyzes or stores.

    Your Data
    If NUVI has your personal data, it is either because you provided it to us directly for legitimate business purposes of NUVI (you are a NUVI customer, vendor or other business contact), or because you posted something online publicly, and we received it from our Content Providers. If you are protected under GDPR and wish to exercise your rights to control your data, you can adjust your online privacy settings or make a request through the social media platform(s) on which you posted, and they may forward requests to us if our action is required. If you provided personal data directly to NUVI or a NUVI Customer, and you are protected under GDPR, you may contact us at DPO@nuvi.com to make a request regarding your data.

    Our Process
    The Services and all associated intellectual property rights are the sole property of NUVI and its licensors and suppliers, and no property rights therein are granted to Customer or any Authorized User. Customer acknowledges that NUVI has limited rights in and does not convey any rights to any text, music, data, graphics, photos, video, commentary and other similar content, including metadata, user and demographic information associated with such content, uploaded, posted or appearing on any internet site that is obtained by NUVI (together, “Source Content”). Customer may only use Source Content in connection with its use of the Services and Customer agrees to be bound by the terms of service of each site providing Source Content, including the Twitter terms of service located at http://twitter.com/tos. Customer shall be solely responsible for the manner in which it uses or displays Source Content or any additional information, data, or NUVI work product prepared, gathered, organized or displayed through the Services (“Platform Content”) and agrees not to use Source Content or Platform Content in a manner that (i) exceeds the rights licensed hereunder by NUVI, (ii) infringes or violates any right of any third party, or (iii) is offensive, harmful, inaccurate or deceptive. The provision of Source Content is subject to availability from third party providers and NUVI shall have no liability should such Source Content become unavailable for any reason. NUVI MAKES NO OTHER WARRANTY WITH RESPECT TO ANY SOURCE CONTENT. SOURCE CONTENT IS MADE AVAILABLE BY NUVI ON AN "AS IS, AS AVAILABLE" BASIS.
